ASVABAI Privacy Policy

1. Introduction

ASVABAI (“we,” “us,” “our,” or “the Platform”) is an ASVAB test preparation platform operated by NY1 Management LLC (“Company”). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. It applies to all users of ASVABAI, including Candidates and Recruiters.

By creating an account or using ASVABAI, you agree to the practices described in this policy.

2. Information We Collect

2.1 Information Candidates Provide

When a Candidate creates an account, we collect:

• First and last name
• Email address
• Password (stored as a secure hash; we do not have access to your plain-text password)
• Date of birth
• Education level
• Target military branch (or “Not sure yet” / “Prefer not to say”)
• High school (or “Not currently in high school / N/A”)
• Guardian email address, for Candidates who indicate they are under 18 (see Section 6, “Minors’ Privacy”)

We use your date of birth to confirm you meet our minimum age of 15 and to apply the additional protections for Candidates under 18, including the guardian email and notification process described in Section 6.

2.2 Information Recruiters Provide

When a Recruiter creates an account, we collect:

• Full name
• Rank
• Email address (a .mil address, or another address subject to manual review)
• Branch of service
• Recruiting station/office
• Phone number (optional)

Recruiter accounts registered with a .mil email address are approved automatically. Accounts registered with any other email address are held for manual review, which may include contacting the recruiter or their recruiting station, before access is granted. We may deny or revoke Recruiter access at any time if we cannot verify a recruiting role or if our Terms of Service are violated, and a Recruiter whose access is denied or revoked loses all access to Candidate information immediately.

2.3 Information Generated Through Use of the Platform

As you use ASVABAI, we automatically collect and store:

• Practice test responses, scores, and accuracy by subtest and subcategory
• Study session activity, including time spent and login frequency
• Messages sent through the Platform between connected Recruiters and Candidates
• Device type and basic technical information (such as browser type) used to operate the Platform securely

2.4 Payment Information

If you purchase a paid subscription, payment is processed by Stripe, a third-party payment processor. ASVABAI does not collect, store, or have access to your full payment card details. Stripe’s own privacy policy governs the information you provide directly to them.

3. How We Use Your Information

We use the information we collect to:

• Create and maintain your account
• Deliver practice questions and track your performance and progress
• Identify areas where you may benefit from additional practice
• Enable the Recruiter-Candidate connection feature described in Section 4
• Process payments for paid subscriptions
• Operate, secure, and improve the Platform
• Communicate with you about your account or the Platform
• Comply with legal obligations

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. ASVABAI does not display advertising, and we do not share your information with advertisers.

4. Recruiter Dashboard and Data Sharing

ASVABAI includes a feature that allows military Recruiters to connect with Candidates who choose to share their progress with them. This sharing only occurs with the Candidate’s explicit consent, through the following process:

1. A Recruiter may find a Candidate by searching for their name or email address. Before the Candidate accepts a connection request, the Recruiter sees only the Candidate’s name. The Recruiter cannot view the Candidate’s scores, study activity, or other information, and cannot message the Candidate, until the Candidate accepts.
2. The Recruiter may send a connection request to the Candidate.
3. The Candidate is shown, before accepting, exactly what information will be visible to the Recruiter.
4. The Candidate may accept or decline the request.
5. If accepted, the Recruiter can view: practice test scores, study time, accuracy by subtest and subcategory, login activity, and target branch.
6. A Recruiter with an accepted connection cannot view: payment or billing information.
7. A Candidate may disconnect from a Recruiter at any time. Once disconnected, the Recruiter immediately loses access to that Candidate’s information going forward.

Recruiters cannot view or contact Candidates who have not accepted a connection request from them, except where a Candidate has separately opted in to being discoverable (such as through school-based search, if and when that feature is enabled).

5. Messaging

Candidates and Recruiters who are connected may exchange messages through the Platform. Messages between a connected Candidate and Recruiter are stored and cannot be edited or deleted by either party. We retain them for 3 years after the connection ends or the account is deleted, unless a longer period is required for safety, dispute resolution, or law. We do not allow Candidate-to-Candidate messaging.

6. Minors’ Privacy

ASVABAI is intended for users who are at least 15 years old. We do not knowingly permit account creation by anyone under 15.

For Candidates who are under 18:

• At registration, we display an informational notice recommending that the Candidate discuss use of the Platform with a parent or guardian. This notice does not prevent account creation.
• We require a guardian email address as part of account creation.
• Each time a Candidate under 18 connects with or disconnects from a Recruiter, we automatically send a notification email to the guardian email on file. The email identifies the Recruiter and branch involved and describes the information shared, which includes the Candidate’s practice scores, study time, accuracy by subtest, login activity, and target branch. It does not include payment information or message content. This occurs automatically and does not require any action from the Candidate or guardian.
• A Candidate may disconnect from a Recruiter at any time. Disconnection ends the Recruiter’s access immediately, and we email the guardian.

We encourage parents and guardians to talk with their child about their use of ASVABAI. If you are a parent or guardian and have questions about your child’s account, you may contact us using the information in Section 12.

7. Data Sharing with Third Parties

We do not sell your personal information. We share information only in the following circumstances:

• With Recruiters, only as described in Section 4, and only with the Candidate’s consent.
• With service providers who help us operate the Platform, including our hosting provider (Kinsta), content delivery and security provider (Cloudflare), payment processor (Stripe), and analytics provider (Google). These providers may use your information only to provide their services to us, and not for their own advertising purposes.
• If required by law, such as in response to a valid subpoena, court order, or other legal process.
• To protect safety, if we believe in good faith that disclosure is necessary to prevent harm to a user or others.

8. Cookies and Analytics

We use cookies that are necessary to run the Platform, such as keeping you logged in and remembering your session. We also use Google Analytics to understand how visitors find and use ASVABAI, such as which pages are visited and how people arrive at the site. Google Analytics collects information such as your approximate location, device and browser type, and pages viewed. We do not use this information for advertising, and we do not use advertising cookies or advertising pixels. Our security provider, Cloudflare, may process basic technical data, such as IP address, to protect the Platform.

9. Data Security

We take reasonable measures to protect your information, including encrypted connections, restricted access to backend systems, and security practices appropriate to the sensitivity of the information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Security Incidents. If we learn of a security incident that affects your personal information, we will notify affected users and, where the law requires, the appropriate regulators, within the time the law requires.

10. Data Retention and Account Deletion

We keep your information for as long as your account is active. You may delete your account at any time through your account settings. When you delete your account, your personally identifiable information is removed from our active systems within 30 days, any Recruiter’s access to your information ends immediately, and performance data may be kept in anonymized, aggregate form. We remove your identifiers (such as your name, email address, date of birth, school, and guardian email) so that the remaining data cannot reasonably be linked back to you. Some information is kept after deletion, as shown in the table below. We may also keep information longer when needed to comply with the law, resolve a dispute, or protect someone’s safety.

11. Your Rights and Choices

Depending on your location, you may have rights to access, correct, or delete the personal information we hold about you. You may exercise these rights by contacting us using the information in Section 12, or, where available, through your account settings directly.

13. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Platform or by other reasonable means. Continued use of ASVABAI after changes take effect constitutes acceptance of the revised policy.
