1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of ASVABAI (the “Platform”), operated by NY1 Management LLC (“Company,” “we,” “us,” “our”). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
If you are between 15 and 17, your use of the Platform is conditioned on providing a parent or guardian’s email address, and on the guardian notification process described in our Privacy Policy. We encourage you to review these Terms with a parent or guardian.
2. Not Officially Affiliated with the Department of Defense
ASVABAI is an independent, privately operated test preparation platform. It is not affiliated with, endorsed by, sponsored by, or officially connected to the United States Department of Defense, the Military Entrance Processing Command, or any branch of the U.S. Armed Forces.
“ASVAB” refers to the Armed Services Vocational Aptitude Battery, a trademark of the U.S. Department of Defense. The name “ASVABAI” incorporates this term solely to describe the subject matter of our practice content — namely, ASVAB test preparation — and is not intended to suggest or imply any official endorsement, license, sponsorship, or affiliation with the U.S. Department of Defense or any military branch. No such endorsement, license, sponsorship, or affiliation exists.
Any predicted scores, accuracy percentages, or performance feedback provided through the Platform are estimates based on practice performance and are not official ASVAB scores and do not guarantee any particular outcome on the actual ASVAB examination.
3. Eligibility
You must be at least 15 years old to create an account. We do not knowingly permit account creation by anyone under 15.
If you are between the ages of 15 and 17, you must provide a genuine email address for a parent or guardian when you register. Providing a false guardian email violates these Terms. Your use of the Platform, including any connection with a Recruiter, is subject to the guardian notification process described in our Privacy Policy.
4. Account Types
4.1 Candidate Accounts
Candidate accounts are intended for individuals using the Platform to prepare for the ASVAB.
4.2 Recruiter Accounts
Recruiter accounts are intended for military recruiting personnel whom we approve as Recruiters. Recruiter accounts are free. Accounts registered with a .mil email address are approved automatically; accounts registered with any other email address are held for manual review. We may deny or revoke Recruiter access at any time if we cannot verify a recruiting role or if these Terms are violated.
You agree to provide accurate information when creating an account and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.
5. Paid Access and Payment
ASVABAI offers a free tier with limited access and a paid tier with expanded access, as described on the Platform at the time of purchase. Payment is processed through Stripe.
Paid access is a one-time purchase. It gives you access to the paid content for the access period stated at checkout, beginning on the date of purchase. The price and access period are shown at checkout before you pay. Taxes may apply. All sales are final, subject to any rights that cannot be waived under applicable law. We may offer additional paid features in the future; those will be priced and described separately and will not change what you have already purchased.
ASVABAI does not display advertising on any tier of service, free or paid.
6. Recruiter-Candidate Connections
Candidates may choose to connect with Recruiters through the Platform. This connection is entirely voluntary and requires the Candidate’s explicit consent before any information is shared, as described in our Privacy Policy. A Candidate may disconnect from a Recruiter at any time.
Recruiters agree to use information obtained through the Platform only to support a Candidate’s ASVAB preparation and enlistment process. Recruiters agree not to:
- Contact a Candidate through the Platform except through an accepted connection
- Export, resell, or upload Candidate information into a personal CRM or any other system, except as required for official recruiting duties
- Attempt to access payment, billing, password, or message information beyond what our Privacy Policy allows
- Misrepresent their identity, rank, or recruiting role
When a Candidate disconnects, the Recruiter’s access to that Candidate’s information ends immediately. We may revoke a Recruiter account if verification fails or if this section is violated.
7. Messaging
Messages between connected Recruiters and Candidates are stored and cannot be edited or deleted by either party. Retention is described in our Privacy Policy. Messaging between Candidates is not permitted on the Platform.
8. Acceptable Use
You agree not to:
- Provide false information during registration, including misrepresenting your age, identity, or recruiting affiliation
- Misrepresent your identity, rank, or recruiting relationship
- Contact a Candidate through the Platform except through an accepted connection
- Use the Platform to harass, threaten, or send inappropriate content to another user
- Attempt to access another user’s account without authorization
- Scrape, copy, republish, or redistribute the question bank or other Platform content
- Attempt to interfere with or disrupt the Platform’s operation or security
- Use the Platform for any unlawful purpose
We reserve the right to suspend or terminate any account that violates these Terms.
9. Question Content and Accuracy
Practice questions on the Platform are generated with the help of AI and reviewed by educators before publication. Review does not guarantee that every question is free of error. If you believe a question is inaccurate, you may flag it through the Platform for review.
The Platform’s practice content, question bank, and underlying methodology are the proprietary property of the Company. We grant you a personal, non-transferable, limited license to use the question bank within the Platform for your own test preparation. You may not scrape, bulk download, copy, redistribute, or use the content to train another AI model.
10. Account Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, and you will not be entitled to a refund in that case. If we terminate your account for any other reason, we will refund the unused portion of your paid access.
11. Disclaimer of Warranties
The Platform is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that any estimated performance data or feedback will accurately predict your actual ASVAB score or enlistment outcome.
12. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute will be brought in the state or federal courts located in Galveston County, Texas.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform. For material changes to price, data sharing, or the rules for users under 18, we will give notice before the change takes effect. Continued use of ASVABAI after changes take effect constitutes acceptance of the revised Terms.
